Goodbye to Local Control? State Housing Laws and the Builder's Remedy

This course will provide an update on some of the key housing laws the California Legislature has passed since 2017, designed to address the state’s housing crisis. The new legislation significantly reduces the discretion cities and counties have in reviewing housing projects. The course will also cover under what circumstances the “Builder’s Remedy” is available.

Learning Objectives:

  • To identify four key laws designed to increase housing supply;
  • To evaluate the effectiveness of the new legislation in increasing housing supply;
  • To learn about frequently litigated issues under the new laws;
  • To evaluate under what circumstances the “Builder’s Remedy” is available.

Dolores Bastian Dalton

Dolores Bastian Dalton has more than thirty years’ experience litigating and mediating land use, commercial, and public entity issues on behalf of plaintiffs and defendants in state and federal trial courts, and on appeal. She has litigated and settled a number of cases brought under the Housing Accountability Act, Density Bonus Law, SB 35, and the Housing Crisis Act. She has specialized expertise in summary judgment and appellate work; Ms. Dalton has been certified by the State Bar of California as a specialist in appellate law. Ms. Dalton is also a trained mediator and mediation trainer, and a member of the mediation panels for the California Court of Appeal for the Third, Fifth and Sixth Districts. She has successfully mediated numerous complex civil disputes, including land use and CEQA cases.

Ms. Dalton has taught Practical Litigation Skills at the University of San Francisco School of Law, and is the former chair of the City of Albany Planning Commission., She obtained her undergraduate degree at the University of California, Berkeley, and her law degree at the University of San Francisco School of Law, where she was a Comments Editor of the Law Review.

Barbara E. Kautz practices with Goldfarb & Lipman LLP in the areas of land use, with an emphasis on housing-related legislation, including the Housing Accountability Act, SB 35, inclusionary zoning and implementation, density bonuses, and other recent changes to housing law; CEQA/NEPA compliance; and affordable housing. Ms. Kautz has over 40 years of land use experience. Prior to joining Goldfarb & Lipman LLP, she was the Community Development Director and Assistant City Manager for the City of San Mateo, California. She speaks frequently at conferences and before public agencies regarding housing issues and is a Fellow of the American Institute of Certified Planners, member of the Board of Counselors at USF School of Law, and past editor of the Land Use chapter in the Municipal Law Handbook. She formerly served on the Boards of Directors for the League of California Cities and the California Chapter of the American Planning Association. Ms. Kautz received her law degree summa cum laude from the University of San Francisco, holds a Master of City Planning from the University of California, Berkeley, and is a Phi Beta Kappa graduate of Stanford University.
