Regular Rate of Pay and other California Wage and Hour Peculiarities

We will cover the legal definition of the regular rate of pay and how it impacts claims for overtime, and meal/rest period payment violations. Also, we will cover best practices for timekeeping, whether employers are safe to round time entries, and paying employees on time for wages and bonuses.

Sarah Hirschfeld-Sussman is an attorney at Dickenson Peatman and Fogarty (DP&F) in their employment law practice group. She represents clients in matters involving various employment issues including wage and hour, discrimination, reasonable accommodation, leaves of absence, and implementing state and federal regulations. She also assists clients in analyzing the legal risks associated with hiring, disciplining and firing, and represents her clients’ interests in both administrative proceedings and litigation. Additionally, Sarah publishes legal updates and provides workshops and training on various employment topics.
Prior to joining DP&F, Sarah represented public entities in labor and employment matters and all aspects of the collective bargaining process. Sarah assisted public entities in resolving grievances, litigating unfair labor practice charges, and handling personnel matters, including employee discipline, layoffs, and termination. 
Sarah is a Sonoma County native, graduating from Analy High School in Sebastopol before attending Brown University and Washington University School of Law. Sarah eventually made her way back to Sonoma County where she enjoys exploring this beautiful area with her husband and two young sons.

Samantha Pungprakearti (“Poong-pre-ket”) is an attorney focusing on employment law and business disputes.
